Small claims court is a division of the Quebec Court where the rules of practice are simplified. The law and the rules of practice enable a citizen and also companies to sue for any amount under seven thousand dollars (7,000$). Before this division of the Court, citizens MUST represent themselves. There aren't any lawyers allowed except for a company, an association or a society. These can be represented by any full time employee and it may very well be a lawyer. The maximum amount of your claim must be 7 000$, before interest. Anyone having a claim for a superior amount, let’s say 10 000$, may want to reduce their claim to 7 000$ in order to gain the right to pursue the claim before Small Claims Court because the procedure there is simplified and to avoid lawyer fees. Caution ! Certain cases are excluded from the jurisdiction of Small Claims Court. Any claim related to leases are excluded and any claim that requires class action too, as are also libel cases. Thus it would be prudent to get some good information before you address the Court. We can help you to prepare your case or your plea with some information, we can help you to get support for your argumentation because we can research the jurisprudence in order to provide you with support and we can explain to you the procedure and tell you what delays you can expect before this section of the Court. You don’t want to be taken by surprise. |
